PRIVACY POLICY for DAILY KOS ONLINE ACTIVISM TOOLKIT

Kos Media LLC (“Kos Media”, “Daily Kos”, “we”, “us”, “our”) and its subsidiaries and affiliates, provides the Daily Kos Online Activism Toolkit (the “App”) for users to securely encrypt email addresses and/or telephone numbers so that unique email addresses and/or telephone numbers can be identified, matched and tracked without disclosing the actual email address to other parties. Your use of the App is subject to this Privacy Policy. By accessing and using the App, you accept and agree to this Privacy Policy. If you do not agree to this Privacy Policy, you shall not use the App.

Information We Collect about You

We collect information to provide services and/or information that you request, and this Privacy Policy explains data collection and use practices.

Kos Media is committed to protecting your privacy. We may collect information about you through your use of the App. Some of the information we collect may personally identify you. For example:

  • Although we do not process payments through the App, you may provide general transaction information when using the App (e.g., purchasing or registering a product or requesting information), including, for example your name and address.
  • Email, name, organization, the date you signed up for the App, and other information may be collected as a part of our analysis of your use of our App.

We may send out important notices informing you of changes to our policies, technical service issues related to a product or service, or other information that is essential to the use of our App.

    We are committed to protecting the security of your personal information and we honor your choices for its intended use. We have implemented the appropriate safeguards to protect your data from loss, misuse, unauthorized access or disclosure, alteration, or destruction. For example, your personal information is stored in password-controlled servers with limited access. We make good faith efforts to provide the security measures necessary to keep the integrity and confidentiality of your information safe. However, no system can be completely secure and we do not guarantee that our security measures are impenetrable.

    Version Updates

    The App may compare you locally stored version of the App to the latest version in order to update your version to the latest update.

    Modifications to the Privacy Policy

    Kos Media may update and make changes to the Privacy Policy at any time. When we do so, we will also revise the date at the bottom of the first page of the Privacy Policy. When we make material changes to the Privacy Policy, we will notify you by placing prominent notice on the App.

    Children’s Information

    The App is not intended for use by individuals under the age of 18. We do not knowingly collect personal data from nor send requests for personal data to individuals under the age of 18.

    Access to Your Information

    We make good faith efforts to provide you with access so you can edit or update your personal information. You may have the ability to view or edit some of your personal information online. You may review and update this information or request deletions of any and all of your personal information at any time by contacting  privacy@dailykos.com.

    Note to California Residents: California Civil Code Section 1798.83 allows California residents to request information regarding disclosure of personal information to third parties for the third parties’ direct marketing purposes. To make a request, please contact privacy@dailykos.com. We do not sell personal information.

    Information About, Access to and a Copy of Personal Information: You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months and to request a copy of the specific pieces of personal information that we have collected. If we receive and verify your request (see below), we will disclose to you:

    (a) The categories of personal information we collected about you; (b) The categories of sources for the personal information we collected about you; (c) The categories of third parties, if any, with which we have shared your personal information; (d) The categories of personal information, if any, that we shared with a third party for a business purpose; (e) The specific pieces of personal information we collected about you.

    Deletion Request: You have the right to request that we delete any of your personal information that we have collected from you, subject to certain exceptions. Once we receive and verify your request, we will delete your personal information from our records, unless an exception applies. Among other exceptions, we are not required to delete your personal information if it is necessary for us to maintain it in order to provide you with information or opportunities reasonably anticipated within the context of our ongoing relationship with you, to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; to enable internal uses reasonably aligned with your expectations; or otherwise use your personal information internally in a lawful manner that is compatible with the context in which you provided the information. We will use commercially reasonable efforts to honor your requests for deletion; however, certain information will continue to be active even if you close your account or request deletion, including the log information for downloading the app.

    Your Choice and Rights: You may update your choices regarding the types of communications you receive from us through your online account. You also may opt-out of receiving marketing emails from us by following the opt-out instructions provided in those emails. Please note that we reserve the right to send you certain communications relating to your account or use of the service (for example, administrative and service announcements) via email and other means and these transactional account messages may be unaffected if you opt-out from receiving marketing communications. Do Not Sell Rights: You have the right to opt-out of the sale of your personal information by us. We do not sell any personal information unless you have explicitly opted-in to receive communication from another organization involved in the progressive movement. If you specifically opt in to receive communications from that organization, we may provide or sell to that organization the personal information we have collected about you. Exercising Your Rights: To exercise the rights set out in Deletion Request and Do Not Sell Rights above, please submit a request with your full name, zip code, email address and identification of a posting made or action taken on the Site in the last 12 months, by:

    Only you can submit a request. You can only make a request twice within a 12-month period. Your request must describe what you are requesting with sufficient specificity that we can review and respond to it.

    Response Time: We will attempt to respond to your request within 45 days of receiving it. If we require more time (up to 90 days) we will let you know that and the reason why.

    Non-Discrimination. You have the right to exercise your rights under the CCPA without discrimination. We will not deny access to any opportunities, services, or programs in response to any consumer exercising rights under the CCPA.
